This policy supplements the Terms of Use. In the event of a conflict, a quotation, contract or specific terms expressly accepted for the relevant project will prevail.
1. Purpose and principles
IA‑VATAR is a service designed and operated by Rivieramedias / XV‑PROD. This policy identifies the rights attached to the Website, Services, virtual identities and content created with them. It does not transfer any right beyond those expressly granted.
An original work may be protected from the moment it is created under French law, European Union law and applicable international conventions, including the Berne Convention. The absence of a copyright notice does not constitute a waiver.
2. Assets belonging to IA‑VATAR
Subject to third-party rights, IA‑VATAR or its licensors retain ownership of the Website, the IA‑VATAR name and trade mark, logos, visual identity, interfaces, text, photographs, videos, demonstrations, architectures, databases, documentation, software, code, generic scenarios, methods, workflows, generic prompts, models, mock-ups and graphic assets.
Access to the Service grants only a personal, limited, revocable and non-exclusive right of use in accordance with the subscribed plan. Substantial extraction, reproduction, adaptation, distribution, resale, provision to third parties, reverse engineering or creation of a competing service from these assets requires written permission.
3. Works created with AI assistance
Some assets may be produced with generative artificial intelligence tools used as instruments within a creative process. IA‑VATAR claims rights in its original human contributions, including art direction, design, selection, combination, staging, retouching, animation, editing, writing, configuration and other creative choices.
The legal treatment of AI-generated content is evolving and may differ between jurisdictions. Where a fully automated element is not eligible for protection, this policy does not purport to create an exclusive right that does not exist. Contractual rights, trade marks, designs, databases, trade secrets and rights in human-authored components nevertheless remain applicable.
IA‑VATAR uses third-party tools in good faith and according to their known terms, but cannot warrant that an algorithmic output is absolutely unprecedented. Any reported substantial similarity will be examined seriously.
4. Catalogue skins: a licence, not a sale
Unless agreed otherwise in writing, the licence is personal or limited to the client entity, non-exclusive, non-transferable, non-sublicensable and valid for the duration of the plan. Several clients may select the same skin.
The licence permits use of the skin within the Services and exploitation of lawful productions made while the licence is valid. It does not permit selling, renting, assigning, extracting, distributing or registering the skin as a trade mark, presenting it as an exclusive creation, training a model on it or building a competing catalogue.
When the licence ends, no new production may be created with the skin. Productions lawfully completed beforehand may remain usable, subject to the contract, third-party rights and the absence of misleading use.
5. Avatars created specifically for a client
Unless otherwise stated, the client receives exclusive worldwide rights to use, reproduce, display, adapt and exploit the final personalised assets for the applicable legal term.
This transfer does not automatically include source files, 3D models, prompts, datasets, voices, music, fonts, software, engines, libraries, open-source components, methods, know-how, generic assets or third-party services. Their inclusion must be expressly stated.
The client warrants that it has all necessary permissions when requesting the reproduction of a person, voice, trade mark, outfit, character or other protected element.
6. Productions made by users
Videos, text, scripts, edits, recordings and other original works made by a user with their avatar belong to that user to the extent permitted by law, subject to rights in the skin, incorporated media and licences governing third-party tools.
IA‑VATAR does not claim ownership of a user’s original message, script or edit. This rule does not turn a licensed skin into the user’s property and grants no rights in third-party music, voices, images, logos or content.
Users must review each production before publication and assess its legal availability before significant commercial exploitation or a trade mark filing.
7. Content supplied by users
Users retain their rights in their content. They grant IA‑VATAR a technical, non-exclusive licence limited to the time required to host, copy, convert, process, transmit and display that content solely to perform, secure and maintain the Service.
Users warrant that their content is lawful and that they hold all required rights, consents and permissions. They remain responsible for backups and intended use. A private production will not be used as a commercial reference without permission.
8. Image, voice and personality rights
A real person’s image or voice may be imported, cloned, synthesised or animated only with valid, informed, documented consent appropriate to the intended uses. Permission may be withdrawn under the agreed terms or as required by law.
Identity theft, covert cloning, false commercial endorsement, deceptive or malicious deepfakes, non-consensual intimate content and any exploitation harming a person’s dignity, reputation or safety are prohibited.
9. Third-party software, models and content
The Service may incorporate AI models, voices, music, fonts, libraries, software, APIs, hosting services or media owned by third parties. These assets remain subject to their own licences and terms. IA‑VATAR grants no transfer of third-party rights.
The withdrawal, modification or unavailability of a third-party component may require its replacement or restrict certain future uses.
10. Trade marks, names, domains and distinctive signs
IA‑VATAR, its logos, service names, presentation and distinctive signs may not be used to cause confusion, imply a partnership or register a similar sign without permission. Third-party names and trade marks remain the property of their owners.
Simple links to the Website are permitted where they are not misleading or harmful and do not frame the Website in a way that conceals its origin.
11. Prohibited uses
- copying, scraping or reconstructing the skin catalogue or Website databases;
- reselling access, assigning a licence or sharing source files without permission;
- removing credits, watermarks, metadata or protection measures;
- using IA‑VATAR assets to train or evaluate a competing system;
- creating confusion about the origin, author, identity or endorsement of content;
- infringing copyright, trade marks, designs, trade secrets, image rights or privacy.
12. Traceability and evidence of creation
Subject to data protection law, IA‑VATAR may retain working files, version histories, dates, metadata, correspondence, approvals, technical logs and art-direction records that help establish the origin and stages of a creation.
Each user must retain their permissions, licences, invoices, contracts and evidence of consent. Technical records may constitute evidence without excluding other lawful forms of proof.
13. Reporting an infringement
A notice must be sent to contact@ia-vatar.com and include:
- the claimant’s or authorised representative’s identity and contact details;
- precise identification of the right relied upon and, where possible, evidence;
- the exact URL or location of the material concerned;
- a detailed explanation of the alleged infringement;
- a good-faith statement and relevant supporting documents.
An incomplete request may delay review. Fraudulent or manifestly abusive notices may expose their author to liability.
14. Review, removal and response
IA‑VATAR may preserve evidence, request further information, temporarily restrict content, contact the relevant user or remove access where an infringement appears sufficiently substantiated. An interim measure is not an admission of liability.
The affected user may respond with permissions and arguments. IA‑VATAR may restore the content, maintain the restriction or provide information required by a competent authority.
15. Scope and changes
This policy explains the allocation of rights but is not individual legal advice. Rules governing artificial intelligence and digital creations continue to evolve. Protection and the scope of rights may vary by country, the extent of human contribution and the nature of the content.
This policy may be updated to reflect legal, technical or contractual developments. The version published on the Website applies from its update date without affecting rights already acquired by contract.
